Visit visa to employment visa in the UAE: how a lawful change of status works

A visit visa can become a work visa in the UAE without leaving the country. It happens in exactly one way, through an employer's application to the labour ministry, and it is not something anyone can sell you. Here is the real process, and how to tell it from the imitation.

“We will change your visa once you are there” is said so often, and by so many people who mean so many different things, that it has stopped meaning anything at all. In the UAE there is a real, lawful process that moves a person from a visit visa to a work visa without leaving the country. There is also a large trade in selling the idea of that process to people who will never get it. Knowing exactly what the real one looks like is the best protection against the imitation.

The short answer

Yes, in the UAE a visit visa can lead to a work visa without the person leaving the country. The UAE is one of the Gulf states where this is possible at all. But it happens in exactly one way: a genuine, licensed employer decides to hire you and applies for your work permit through the proper system. It is not a service. Nobody can sell it to you, and a person who offers to is selling something they do not control.

The UAE government puts the underlying rule plainly: a visit or tourist visa does not give you the right to work in the UAE, and working on one results in fines and legal liability. Everything below follows from that sentence.

How a lawful change of status works

The details vary a little between emirates and employers, but the order does not.

  1. An employer decides to hire you. You may have interviewed while visiting, on a job seeker visa, or by video from India. Interviewing is not working.
  2. The employer issues an offer through the labour ministry. In the UAE a legitimate offer letter is generated through MOHRE's electronic system and signed by you. It carries a transaction number you can check yourself.
  3. The employer applies for your work permit with MOHRE, and for the change of your residence status with the immigration authority, GDRFA in Dubai or ICP in the other emirates.
  4. Your status is changed inside the country, instead of you having to fly out and come back on a new entry permit.
  5. You complete a medical fitness test and give biometrics for your Emirates ID.
  6. Your residence visa is issued and your contract registered. Only now does the job begin.

UAE labour law makes the employer responsible for recruitment expenses. The exact fees for each step change and differ by case, which is precisely why a flat “conversion fee” quoted to you by a third party should worry you rather than reassure you.

Do not start work while you wait. Starting the job before the work permit is issued is unlawful for you and for the employer, whatever visa you entered on. The 2024 amendments to UAE labour law were reported at the time to raise the fines for employing someone without a permit as high as AED 1 million. An employer willing to risk that on your behalf is not an employer who will protect you when an inspector calls.

Watch the clock

A change of status has to be completed while your visit visa is still valid. If the visa expires first, you become an overstayer, and the fine of AED 50 a day starts in your name, not the employer's. Ask the employer, in writing, how long they expect the process to take, and compare it with the date on your visa.

The Indian side of it

There is a second set of rules, and it is Indian. The protections the Emigration Act gives Indian workers, including the compulsory insurance that ECR passport holders carry when they go abroad to work, attach to jobs taken through the emigration process. A job taken after arriving on a visit visa sits outside that process. Indian missions in the UAE have for years advised against using visit visas to look for work for exactly this reason. The red flags

  • Someone charges you to “arrange” the change. The employer applies. There is nothing for a middleman to arrange.
  • You are asked to start work while the papers are processed. That is the unlawful part, and you carry the risk of it.
  • The offer letter has no MOHRE transaction number, or the number does not check out.
  • You are told to leave and come back on a fresh visit visa to keep working. That is not a change of status. It is continuing to work illegally with extra flights.
